It sets up some expectations and then it delivers something unexpected. That's a pretty standard formula for humor.
It's the same thing you have in:

The Holocaust.

Police said they spent some time working out if they could charge the man with being armed with a weapon, as technically he was armed with part of a fish.

See, I see why you say that yours is the same delivery as the comic, but I disagree. Yours would need some poor joke/observation in a single frame, and then tell the misdirect joke. I'd probably feel better about the comic without the picture. I'd probably feel better about the comic with the caption put above the picture (as then you can basically ignore the picture altogether). I'd definitely feel better about the comic without the throw away threat after the punchline, that ultimately had nothing at all to do with the picture or the joke.
Zach has been great at the misdirect. This is not a good example.
